By accessing or using Here’s a Buck ("Platform," "we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you do not agree, you must not use the Platform. You must be at least 18 years old to use the Platform.
1. Nature of the Platform
Here’s a Buck is a technology platform that enables individuals ("Creators") to receive voluntary contributions ("Donations") from supporters ("Donors").
We:
- Do not create, control, manage, verify, endorse, or guarantee campaigns
- Do not supervise or audit use of funds
- Do not act as a bank, escrow agent, broker, charity, fiduciary, or financial institution
- Do not take legal custody or ownership of funds
All payment processing and payouts are handled by Stripe. By using the Platform, you also agree to Stripe’s applicable terms and policies.
Unless explicitly stated otherwise, Donations are not tax deductible.
2. Donations, Payments, and Holds
Donations are voluntary and generally non refundable except where required by law.
Stripe may delay, reverse, dispute, freeze, or block transactions for compliance, fraud prevention, regulatory, or risk reasons. We do not control Stripe’s decisions.
Donations are subject to a minimum seven day hold period. Payouts are processed in scheduled batches once a Creator’s Stripe account is fully enabled.
We reserve the right, at our sole discretion, to:
- Delay, withhold, reverse, or cancel payouts
- Offset future payouts for disputes or chargebacks
- Investigate suspicious activity
- Require additional verification
- Restrict accounts or funds
This may occur in cases of fraud, abuse, disputes, policy violations, legal risk, regulatory compliance, or risk mitigation.
3. Creator Responsibilities
Creators are solely responsible for:
- The accuracy and legality of campaign content
- The lawful use of funds
- All required disclosures
- Taxes, reporting, and regulatory compliance
- Communication with Donors
We do not guarantee that funds will be used as described.
Any dispute between a Donor and a Creator is solely between those parties. We are not responsible for resolving user disputes.
4. No Guarantees and Platform Availability
The Platform is provided on an "as is" and "as available" basis.
We make no guarantees regarding:
- Accuracy of campaign claims
- Success of campaigns
- Availability or uptime
- Security against third party attacks
- Suitability for any specific purpose
Use of the Platform is at your own risk.
5. Platform Is Free
Here’s a Buck does not charge a platform percentage fee on Donations unless stated otherwise. Payment processing fees from Stripe or other processors may still apply.
We reserve the right to introduce fees in the future with notice.
6. Prohibited Use and Enforcement
You may not use the Platform for unlawful, fraudulent, deceptive, abusive, harmful, or misleading activity.
We may, at our sole discretion and without prior notice:
- Reject or remove campaigns
- Suspend or terminate accounts
- Freeze or withhold funds
- Report activity to authorities
- Take any action necessary to protect the Platform
We are not liable for losses resulting from enforcement actions.
7. Indemnification
You agree to indemnify, defend, and hold harmless Here’s a Buck, its owners, affiliates, contractors, and agents from any claims, damages, losses, liabilities, legal fees, or expenses arising from:
- Your use of the Platform
- Your campaign or content
- Your violation of these Terms
- Any dispute between users
- Any misuse of funds
This obligation survives termination of your account.
8. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
- We are not liable for lost profits, lost data, reputational harm, or business interruption.
- Our total aggregate liability shall not exceed the amount you have paid directly to Here’s a Buck in the preceding twelve months, which may be zero.
Some jurisdictions do not allow certain exclusions; in those cases liability will be limited to the minimum permitted by law.
9. Arbitration and Class Action Waiver
Any dispute arising from or relating to these Terms or the Platform shall be resolved exclusively through binding arbitration in the State of Delaware.
You waive the right to:
- A jury trial
- Participate in a class action
- Participate in a representative proceeding
Arbitration shall be conducted under the rules of a recognized arbitration organization. Each party bears its own legal costs unless otherwise required by law.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
11. Modifications
We may modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
12. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
